Renting out property in Abuja: notice periods and recovering possession

Updated 24 October 2026 · 6 minute read

Lagos has its own Tenancy Law, but in the Federal Capital Territory landlords generally rely on the Recovery of Premises Act together with the tenancy agreement. The steps are similar to Lagos, with some differences in wording and procedure.

Not legal advice. This is a general summary. Procedure in the FCT courts has specific forms and rules, so use a lawyer for any notice you intend to rely on in court.

Start with the agreement

As everywhere, the tenancy agreement comes first. If it sets a notice period or a fixed end date, that generally applies. The statutory periods below fill the gap where the agreement is silent.

Notice to quit periods in the FCT

Tenancy typeUsual minimum notice
Tenancy at will or weeklyOne week
MonthlyOne month
QuarterlyOne quarter (three months)
YearlyHalf a year (six months)

For periodic tenancies, notices have traditionally needed to end on the last day of a tenancy period, so a yearly notice should expire on the anniversary of the tenancy. Getting this date wrong is one of the most common reasons notices fail.

The steps to recover possession

  1. Notice to quit for a periodic tenancy, or let a fixed term expire.
  2. Seven days’ notice of the owner’s intention to apply to recover possession, served after the notice to quit expires.
  3. Court claim for possession, often with a claim for arrears and mesne profits.
  4. Enforcement by court officials if the court grants possession.

Our notice to quit guide covers what a notice should say and how to prove service; the same principles apply in Abuja.

Abuja-specific points

Never use self-help

As in Lagos, locking out a tenant, removing doors or cutting utilities without a court order is unlawful and can expose you to damages. Go through the notices and the court.

Plan the dates from the start

With six months’ notice for yearly tenancies, the time to decide is well before renewal. Landlord Reminder tracks each tenancy’s renewal date and reminds you three months, one month and seven days ahead. For Lagos properties, see the Lagos Tenancy Law guide.
